They are experimenting with methods to insulate Republican power from popular will. ... Something that has evolved over a period of years is that Republicans have utilized the counter-majoritarian levers of democracy more and more. The Supreme Court is one of those, but it is also the case that, as a question of legal ideology, the Supreme Court is hostile to federal efforts to insure that American's democratic rights are respected. The Court is underappreciated among Democrats as an accelerating force of democratic decline. ... To some extent elite lawyers are reliant upon the prestige of the Court when they make their arguments before the Court. There is a real structural impediment where the Republican party and the conservative movement can attack the Court in a scorched earth way regardless of how big their majority. Democrats cannot do this because such a key part of their constituency is Ivy League lawyers.
ibid ADAM SERWER The Court, despite certain moments, is generally not an ally to the powerless. It is an ally to the powerful. It is substantially shaped by public opinion. ... Historically, the court is not a heroic institution that is going to save powerless people from powerful people. They are going to do the opposite. The Court can essentially ignore the Constitution when it wants to. ... There is a long history of Americans defying the Court in particular ways. Conservatives don't want you to think about that history, because conservatives use those same ways in order to stall or prevent social changes that the law or Supreme Court rulings might require.
ibid ADAM SERWER Justice Alito has inherited the Justice Scalia mantle. Alito feels he is entitled to embed socially conservative positions in the law; not because they have anything to do with the law, but because he sees himself as the guardian of these put-upon, socially conservative Americans who no longer have a voice. He sees himself as the champion of these downtrodden. Therefore, whatever he says that people might take offense at, he's entitled to embed their values and use them as law because he is their champion. ... If he is disgusted by something, he thinks it's unconstitutional.

the thing is, how do i know the echo doesn't stop as soon as i leave the space? exactly. so if i crept back all ninja with my reed sandals and split-toe socks, i would still hear the inhalations for the next stanza. the next conception. the next nextness. the problem with tinnitus is white noises itself. not noise cancelling headphones. self cancelling audio curtain. but of course, it isn't the slurping, meaty mechanical bits that raise the ruckus. tinnitus is the sound of synapses and cerebral blood flow. can't be anything else. the last time i looked, the abandoned Howard Johnson's Motor Lodge(HoJoMoLo) in Greenville, South Carolina was still standing. probably not now. something tangential to my personal orbit happened in one of those rooms in 1972. i don't stutter, i said nineteen seventy two. it was a bleak and trying time. that and it was repetitive.
